Privacy policy

This policy explains how Magellan SL handles personal data: from visitors to www.magellan-sl.com, from people who buy, sell or own property with us, and from anyone who contacts us. It complies with the EU General Data Protection Regulation 2016/679 (GDPR) and Spain's Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

2. What data we collect

  • Website enquiries: the details you enter in our contact form (name, email, phone if you give it, your message, the property or promotion you ask about, the language of the page) and the time you accepted this policy.
  • If you contact us by phone, WhatsApp or email: the details you give us.
  • Buyers: contact details, what you are looking for, viewings and your feedback, offers, and, if you buy, identity documents (passport or ID, NIE) and the transaction details we need to complete the purchase.
  • Sellers and owners: contact details, details and photos of your property, ownership and property documents, the terms agreed for the sale, and identity documents.
  • Newsletter: your name and email, if you subscribe.
  • Technical data: IP address, browser and pages visited, logged automatically by our hosting provider for security.

We do not ask for special-category data (health, beliefs, etc.).

3. Why we use it and our legal basis

We do not make automated decisions about you or build profiles.

4. Who we share it with

We never sell your data. We only share it when needed:

  • The other party to a sale (buyer or seller) and developers: only the details needed to arrange a viewing, an offer, a reservation or the sale.
  • Lawyers, notaries, gestorías, the Land Registry and public authorities, to complete a sale or when the law requires it.
  • Banks and mortgage brokers, only if you ask us to put you in touch.
  • Property portals: when we advertise a property, the portals receive the property details and photos, not the owner's personal data. When you enquire through a portal, the portal passes your enquiry to us and handles your data under its own privacy policy.
  • Service providers who process data on our behalf under a contract: our website and email hosting, our property and client software, and our newsletter service.

5. International transfers

We keep your data within the EU wherever possible. If a service provider processes data outside the EU, the transfer is covered by the EU-US Data Privacy Framework or by the European Commission's standard contractual clauses. The Google map on our contact page (see section 8) is provided by Google and only loads if you ask for it.

6. How long we keep it

  • Enquiries that don't lead to a sale: two years from our last contact.
  • Clients (buyers and sellers): for the duration of our relationship and then for up to six years, to meet accounting and tax obligations and deal with any claims.
  • Anti-money-laundering records: ten years, as required by Law 10/2010.
  • Newsletter: until you unsubscribe.
  • Server logs: for the limited period set by our hosting provider for security.

7. Your rights

At any time, you have the right to:

  • access your data;
  • correct inaccurate data;
  • erase your data;
  • restrict how we use it;
  • object to processing based on legitimate interest, including direct marketing;
  • data portability;
  • withdraw consent where you have given it, without affecting earlier processing.

Email sales [at] magellan-sl.com or write to the address in section 1. We will reply within one month. If we have reasonable doubts about your identity, we may ask you to confirm it.

If you think we haven't handled your request properly, you can complain to the Spanish Data Protection Agency, the Agencia Española de Protección de Datos (C/ Jorge Juan 6, 28001 Madrid, www.aepd.es).

8. Cookies

This website sets no cookies of its own and uses no analytics or advertising tools. Its fonts are served from our own server. The map on our contact page is provided by Google Maps, which sets its own cookies, so it only loads when you click "Show map". Links to WhatsApp, Google Maps and the websites of our promotions take you to those services, which have their own privacy policies.

9. Security and changes

The website uses an encrypted connection (HTTPS), and we take appropriate technical and organisational measures to protect your data. If we change this policy, we will publish the new version here with its update date.
